Agreement to these Terms

These Terms & Conditions govern your purchase of and participation in the Owaken Breathwork Facilitator Training On-Demand ("OBFT On-Demand").

By purchasing, accessing, or participating in the training, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. Your purchase constitutes your acceptance of this Agreement and creates a legally binding agreement between you and Owaken.

If you do not agree to these Terms & Conditions, you must not purchase, access, or participate in the training.

Program Enrollment

Enrollment grants you access to the training materials, learning platform, and program resources for a total of 24 months from your date of enrollment.

This includes:

• 12 months to complete the training and submit all certification requirements.

• A further 12 months to integrate and implement your learning, revisit the course materials, refine your skills, and continue your personal and professional development.

Payment

Enrollment in the Owaken Breathwork Facilitator Training On-Demand requires payment of USD $6,000, payable in full at the time of purchase.

Payment is securely processed through Owaken's authorised payment provider before access to the training is granted.

Refund Policy

Due to the immediate access provided to digital content, downloadable resources, and Owaken's intellectual property, all payments are non-refundable, except where required by applicable law.

Access to the Training

Upon successful payment, you will receive access to the Owaken Breathwork Facilitator Training On-Demand platform.

Your access is personal to you and may not be transferred, shared, copied, distributed, sublicensed, or sold.

Owaken reserves the right to update, improve, modify, replace, or remove training content, assessments, resources, and platform features where reasonably necessary to maintain the quality and integrity of the program.

While Owaken will make reasonable efforts to provide uninterrupted access, temporary interruptions may occur due to maintenance, updates, or circumstances beyond our reasonable control.

Training Completion

The Owaken Breathwork Facilitator Training On-Demand is a self-paced professional certification program.

To remain eligible for certification, you are responsible for completing all required learning within the initial 12-month training period.

This includes, where applicable:

• Completing all required learning modules.

• Completing all practical exercises.

• Completing all written and practical assessments.

• Completing all required practice facilitation sessions.

• Submitting all required certification documentation.

• Successfully completing any examinations or competency assessments required by Owaken.

Unless otherwise approved by Owaken in writing, all certification requirements must be submitted within the initial 12-month training period.

The additional 12 months of access is provided for continued review, implementation, and professional development only. It does not extend the certification submission period unless expressly approved by Owaken.

Certification

Completion of the training does not automatically result in certification.

Certification is awarded solely at the discretion of Owaken once all certification requirements have been successfully completed and approved.

Owaken reserves the right to:

• request additional information or evidence of competency;

• require reassessment where competency has not yet been demonstrated;

• decline certification where the required standards have not been met.

Certification confirms that, at the time of assessment, the graduate has demonstrated competency against Owaken's certification standards.

Maintaining Certification

Certified facilitators agree to uphold the professional standards, Code of Ethics, and values of Owaken.

Owaken reserves the right to introduce continuing professional development requirements, certification reviews, or recertification requirements to maintain certification.

Owaken may suspend or revoke certification where a facilitator:

• breaches the Code of Ethics or Code of Conduct;

• engages in unsafe or unethical practice;

• misuses Owaken intellectual property;

• falsely represents their certification or affiliation with Owaken;

• acts in a manner that may reasonably damage the reputation of Owaken.

Code of Conduct & Professional Behaviour

Students are expected to conduct themselves respectfully, professionally, and ethically throughout the training.

By purchasing this training, you agree to comply with:

• the Owaken Code of Conduct;

• the Owaken Code of Ethics;

• the Medical Agreement;

• any additional policies, procedures, or guidelines provided by Owaken.

Owaken reserves the right to suspend or terminate access to the training, or refuse or revoke certification, where a student breaches these requirements.

Health & Participant Responsibility

Breathwork is a physical, emotional, and experiential practice.

By participating in this training, you acknowledge that you are responsible for ensuring that participation is appropriate for your individual circumstances.

If you have any medical, psychological, neurological, cardiovascular, respiratory, or other health concerns, you should consult an appropriately qualified healthcare professional before participating.

You acknowledge that participation in the training is undertaken voluntarily and at your own risk.

Intellectual Property

All videos, manuals, workbooks, worksheets, assessments, templates, graphics, downloads, recordings, curriculum, branding, and all other training materials remain the exclusive intellectual property of Owaken.

You may not:

• copy or reproduce any training materials;

• record, download, upload, or distribute course content except where expressly permitted;

• share your login credentials or provide access to another person;

• sell, sublicense, or commercially exploit any aspect of the training;

• create derivative works from Owaken's intellectual property without prior written permission.

Unauthorised use may result in immediate termination of access and may lead to legal action.

Brand Licence

Certification does not grant ownership of, or permission to operate under, the Owaken Breathwork brand.

Graduates may identify themselves as a Certified Owaken Breathwork Facilitator or Certified by Owaken Breathwork.

Certification does not authorise graduates to:

• represent themselves as Owaken Breathwork;

• present themselves as employees, partners, or official representatives of Owaken;

• deliver facilitator training using Owaken's curriculum;

• reproduce, teach, licence, or distribute Owaken's proprietary training materials.

Limitation of Liability

The Owaken Breathwork Facilitator Training On-Demand is provided for educational purposes only.

Owaken makes no guarantee regarding individual personal, professional, financial, or business outcomes resulting from participation in the training.

To the fullest extent permitted by law, Owaken will not be liable for any indirect, incidental, consequential, or special damages arising from participation in the program.

Termination

Owaken reserves the right to suspend or terminate a student's access to the training where these Terms & Conditions, the Code of Conduct, the Code of Ethics, the Medical Agreement, or any applicable policies have been breached.

Termination of access does not entitle the student to any refund.

Governing Law

These Terms & Conditions are governed by the laws applicable to Owaken's operating entity.

Any dispute arising out of or relating to these Terms & Conditions or the training shall be subject to the exclusive jurisdiction of the courts applicable to that jurisdiction.

Entire Agreement

These Terms & Conditions constitute the entire agreement between you and Owaken in relation to the Owaken Breathwork Facilitator Training On-Demand and supersede any prior discussions, representations, or agreements relating to the training.

If any provision of these Terms & Conditions is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

Acceptance of Terms

By purchasing the Owaken Breathwork Facilitator Training On-Demand, you acknowledge and agree that:

• You have read and understood these Terms & Conditions.

• You agree to be legally bound by these Terms & Conditions.

• You agree to comply with the Owaken Code of Conduct, Code of Ethics, Medical Agreement, and any other policies issued by Owaken.

• Purchasing the training does not guarantee certification.

• Certification is awarded only after successfully completing all certification requirements and meeting Owaken's standards.

• You accept responsibility for completing the certification requirements within the designated timeframe.

• All payments are non-refundable except where required by applicable law.

• Your purchase constitutes your acceptance of these Terms & Conditions and creates a legally binding agreement between you and Owaken.
